Fire safety has always been vitally important, and much of the current UK regulation stems from the Regulatory Reform (Fire Safety) Order 2005 and Fire Safety Act 2021. A Fire Risk Assessment is a legal requirement. If you are responsible for a building, for example an employer, owner or occupier of premises that aren't a 'single private dwelling' (a private home), you need to make sure a suitably competent person completes a Fire Risk Assessment. It is your duty to identify fire risks and hazards in your premises and take appropriate action.
In addition, if five or more people work at your premises or your business has a license under enactment in force, you’ll need your fire risk assessment to be a written record. From October 2023 ALL premises falling under the Fire Safety Order will be required to have a written FRA regardless of the number of employees. It’s good business sense as well as a legal requirement, often businesses don’t recover after a fire, and effective fire prevention starts with properly understanding the risks.
No matter who carries out the fire risk assessment the duty holder retains the responsibility for ensuring the adequacy of that assessment. If employing a specialist to undertake your fire risk assessment, whilst you are not expected to be an expert in fire safety, you should make reasonable checks to ensure that they are competent to do the job properly.
